Your building is classed as a public building if it meets all of the criteria below. If so, then you will be required to display an Energy Performance Certificate before 4th January 2009. The certificate is valid for 10 years
Energy Performance Certificates are required only for new sale agreements on or after 4 January 2009.

The trigger is a new building owner
Certificate is valid for 10 years
Energy Performance Certificates are required only for new rental agreements on or after 4 January 2009. 
Building area is over 1000m2
The building is occupied by public authorities OR
Provides public services to
a large number of persons
The building is frequently visited, at least
weekly, by members of the general public
The public have a right of access to the
building or parts thereof providing services
directly to the public
Public funding, even in part

If your building is not a public building you do not need to display an Energy Performance Certificate unless you plan to construct, sell, or rent to a new tenant.
For example: Selling your building before the 4th of January 2009 will not require you to produce an Energy Performance Certificate. Selling on or after the 4th of January 2009 will require an Energy Performance Certificate

New Buildings

Energy Performance Certificates are already required for new buildings

Introduced in May 2007
Certificate is valid for 10 years
The trigger is a new tenant
Certificate is valid for 10 years

For example: Renewing leases or rental agreements to existing tenants on or after the 4th January will not require an Energy Performance Certificate.

A new lease or rental agreement to a new tenant on or after the 4th January will require an Energy Performance Certificate.
